How it works

  1. Read the conditional clause rather than the headline

    Gift cards that have a balance will never expire and are never subject to additional fees. Those first four words carry the whole rule, and almost every summary drops them.

  2. Spend a card down and then let it go

    Once a card reaches zero, the ninety-day clock starts. Keeping the plastic for a future refund only works inside that window, after which the number is dead.

  3. Treat an Invalid error code as a question, not an answer

    It appears for a card drained by somebody else and for a card retired after three empty months. The web form cannot tell those apart, so take the card and receipt to a desk.

  4. Know the floor beneath the promise

    Funds behind a store gift card must stay valid for at least five years from issue or from the last load. Retailers may promise more, and this one promises no expiry at all while money remains.

Each of these promises beats the federal floor, and each hides its catch somewhere else. This one hides it in an adjective, since only a card that has a balance is covered.

Four words doing all the work

Every summary of this policy says the cards do not expire and carry no fees. The published sentence is narrower, and the difference is not academic.

A card holding money is protected against both expiry and fees. A card holding nothing is not protected against anything.

The other half lives on the balance page. A card left at a $0 balance for 90 days is deactivated by the system for security, its number stops working, and it cannot be reloaded or reused. Both halves are true at once: the money never expires, and the empty container is retired after three months. Anyone keeping a spent card in a glovebox for a future return should know the window.

That retirement is legally uncontroversial. Gift card provisions of the Credit CARD Act of 2009, written into Regulation E at section 1005.20 and published by the Consumer Financial Protection Bureau, protect the funds rather than the plastic. Funds must stay valid at least five years from issue or from the last load, and a dormancy, inactivity, or service fee is lawful only after a full year of no activity, once a calendar month at most, and only where the card discloses it. Retiring a card that holds nothing engages none of that. Several states go further than the federal minimum and differ from one another, so no single state rule stands in for the rest.

One consequence is practical rather than legal. A deactivated card returns an Invalid error code, and so does a card somebody else has emptied.
